General terms & conditions governing use of website
  1. This website is owned and operated by Elf Experience Pte Ltd (hereafter termed “Elf Experience”). The terms and conditions herein govern your use of this website. By accessing or using this website, you agree to the terms set out in these terms and conditions. These terms and conditions apply to the sale of goods supplied by us and to the exclusion of all other terms and conditions, unless otherwise specifically agreed in writing.

Your use of this website and any site to which this website is linked to is on an "as is" basis and we make no representations or warranties, express or implied, about the operation of this site and any site to which this website is linked to or the material contained or referred to on it, and will not be held liable in any way for your use of it. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, express or implied, including implied warranties of quality and fitness for a particular purpose. We do not warrant that this website or any site to which this website is linked to or the products and materials contained on such site are error-free, or that errors will be corrected, or that this site or the server from which it is run is free of viruses or other potentially harmful codes. Under no circumstances, including negligence, will we or any affiliated companies or individuals be held liable for any direct, indirect, incidental, special or consequential damages and expenses whatsoever including, without limitation, health problems, lost profits and damages arising from lost data, viruses that may infect your computer, deletion of files or business interruption, arising out of or in any way connected with the use of the this site or for any information, software products or services obtained through our website, whether such damages are based on contract, tort, strict liability or otherwise, even if advised of the possibility of such damages.

All third party trademarks are the property of their respective owners, and cannot be used without permission. Third party trademark references herein do not constitute or imply affiliation with, endorsement, or recommendation of Elf Experience by the respective trademark owners.

  4. The law governing the terms of use of this website shall be subject only to the laws of the Republic of Singapore which shall exclusively govern the interpretation, application and effect of all the above permissions, exclusions, licenses and conditions of use.

  5. In the event of any inconsistency between these terms and conditions and any other printed or written document passing between the parties, the terms and conditions herein prevail. Please read these terms and conditions carefully before placing an order with us.
General information on the Products
  1. Each ElfBox pertains to a specific theme contains:

    • One Elf Experience VoucherOne
    • One-Time Special Offer Voucher
    • One printed guidebook

  2. Each Mix n Match Pack contains:

    • One Elf Experience Voucher
    • One printed guide pack

  3. The ElfBox and Mix n Match Pack will be collectively termed as “Product” here forth.

  4. Experience providers and the experiences they provide to purchasers and beneficiaries in exchange for the vouchers are listed in the guidebook/guide pack. The Elf Experience Voucher is equivalent to a means of payment for a given service proposed in the guide.

  5. The Product’s expiry date is set out on the Product’s packaging and on the Elf Experience Voucher itself. Bookings for redemption have to be made directly with the experience provider before expiring date or the gift certificate will cease to be valid.

  6. While every care and precaution is taken to ensure that the information provided in the guide is correct at the time of print, kindly note that Elf Experience does not guarantee the accuracy of the information and that the information may change from time to time.

  7. Elf Experience reserves the right to change its experience providers and so the experiences provided or represented in the Product may vary during the validity period of the gift certificate.

  8. Any illustrations used in the guide or in the marketing documents are used as an indication only.
Price and availability
  1. Elf Experience accepts all orders for our Products, subject to its availability. Most items displayed on our website are available in stock and ready to be shipped. However, once in a while we may unfortunately run out of a particular title/package before we are able to remove it from our site. In this particular event, we will immediately contact you to let you know and offer you a full refund, store credit or suggest an alternate purchase.

  2. Elf Experience also reserves the right to limit quantities of Products sold or made available for sale on our website.

  3. Elf Experience reserves the right to change any Products offered for sale, and the prices or specifications of any Products at any time and from time to time without any notice or liability to you or any other person.
Making Orders, Delivery and Packaging
Time period
Elf Experience provides 3 delivery options for you:
  1. Normal delivery:

    • Estimated delivery time: 3-4 working days from day of dispatch.
    • Normal delivery costs are S$4* for the first item purchased and S$2 for every additional item.

  2. Super Fast Delivery:

    • Estimated delivery time: 1 working day from day of dispatch.
    • Super Fast delivery costs are S$12* for the first item purchased and S$2 for every additional item.

  3. Turbo Fast Delivery:

    • Estimated delivery time: Within 6 hours from order.
    • Super Fast delivery costs are S$18* for the first item purchased and S$2 for every additional item.

Orders placed on working days:
  • Orders placed before 12pm (Monday to Friday, except public holidays) will be usually dispatched the same working day.
  • Orders placed after 12pm (Monday to Friday, except public holidays) will be usually dispatched the next working day.
Orders placed on weekends and public holidays:
  • Orders placed on weekends and public holidays will be usually dispatched the next working day.
Responsibility
It is the responsibility of the purchaser to correctly address gifts, whether by email, post or courier. Elf Experience cannot be held responsible for any damaged, missing or delayed orders where incorrect or incomplete delivery details (address and, if relevant, appropriate delivery instructions) have been provided.

Standard Post delivery is via Singapore Post. Elf Experience accepts no responsibility for any damage, loss or delay as a result of using Singapore Post's service. We will provide you with the tracking code of your registered mail/Speedpost mail in the event you wish to obtain a status update on your delivery.
 
Number of Products per Shipment
There is no minimum or maximum Product order requirement. However, if you would like to order more than six (6) Products, please contact us.
 
Risk transfer
We can send the Product to you, directly to the recipient, or to another address at your request. Following delivery, risk of damage to or loss of the packages will be passed to you. If the delivery company is unable to deliver the packages because of your unavailability or because of the inaccuracy of the contact details you have provided to us, any subsequent deliveries will be made at your cost.
Payment
Credit/Debit Card payments /E-mail Confirmation
  1. We will have to verify your order and credit or debit card details submitted to us before accepting your order. Once that has been done, we will confirm that your order has been received by sending an e-mail to the e-mail address you provide in your registration form. All credit and charge card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.

  2. For payments on-line, we accept all major credit cards - Visa, Mastercard, American Express. Such on-line payments are processed using PayPal. Payment will be debited to your account before the dispatch of your purchase.

  3. Once you complete your purchase, we will send you an order confirmation e-mail to the e-mail address you have provided in your order form.
Exchange and Refund
Exchange
  • The Products can be exchanged for one of the other Product sold on our website subject to the terms and conditions herein and subject to our right to reject the exchange in the event the content of the Product is incomplete or damaged.

  • To exchange the Product, just mail your original Product back to us, by registered mail, together with a cheque of S$20.00 addressed to “Elf Experience Pte Ltd” for exchange and restocking fees PLUS S$9.00 for standard delivery PLUS any price difference between your original package and the new one you would like, and we will deliver to you a new Product of your choice. There will be no refund if your new chosen Product is less expensive than the original one.
Refund
  • You may obtain a refund if you have not booked your experience with an experience provider and if the Product is returned within seven (7) days purchase.. Products must be returned with all content included and in good condition. Elf Experience reserves the right to object to providing a refund in the event in the event the content of the Product is incomplete or damaged. You will be responsible for the payment of any shipping costs associated with any Product return along with a S$12.50 processing fee.
Purchase from a Retail Store
  • If the Product has been purchased from a retail store, a refund can only be obtained by returning the Product and all of its contents, in good condition, to the place of purchase (except as otherwise agreed with the retail store) together with the corresponding receipt. These refunds will be subject to the store’s own terms and conditions.
Redemption of Voucher
Validity of voucher and expiration date
  1. The Elf Experience Voucher/ One Time Special Offer Voucher included in the Product are valid till the expiration date mentioned on the product and on the vouchers. If you do not use the vouchers before its expiration date, you will not be able to redeem the vouchers in payment of any service, nor claim any reimbursement, liability or indemnity of any kind from Elf Experience, its service providers or any resellers of products. The Product and accompanying vouchers are neither refundable nor replaceable in case of loss, theft or destruction.

  2. The Elf Experience Voucher and One Time Special Offer Voucher are not valid with other offers, services and promotions and are not exchangeable for cash or products.
 
Authentication of voucher
You must present your Elf Experience Voucher/ One-Time Special Offer Voucher along with your identity card to the experience provider so that the experience provider may verify its authenticity. Only the original Elf Experience Voucher/ One-Time Special Offer Voucher is a valid means of payment for services, and photocopies or defective vouchers will not be accepted by experience providers. If presented with an invalid Elf Experience Voucher/ One-Time Special Offer Voucher, experience providers will refuse to provide you with the services.
 
Redemption Process
  1. The Elf Experience Voucher and One Time Special Offer Voucher may be redeemed everyday of the week including weekends, subject to reservations made with the experience provider, the availability of the experience provider and description of the experience in the ElfBox. The vouchers do not include transportation to or from any experience provider.

  2. The Elf Experience Voucher is only valid for one of the activities presented in the ElfBox and can only be redeemed once.

  3. Upon redemption of the Elf Experience, the experience provider will retain the Elf Experience Voucher.

  4. The One Time Special Offer Voucher can be used to redeem all One Time Special Offers set out in the ElfBox and can only be redeemed once with each experience provider.

  5. Upon redemption of the One Time Special Offer set out in the ElfBox, the Experience Provider will mark the allocated space on the One Time Special Offer Voucher to indicate redemption of offer and return the One Time Special Offer Voucher to you to enable you to make redemptions from the remaining experience providers where the One Time Special Offer has not been redeemed.

  6. Upon redemption of all One Time Special Offers, you can mail the One Time Special Offer Voucher to Elf Experience to obtain membership to the Elf Club and corresponding benefits. Please contact us for more details.

  7. One Time Special Offers provided by experience providers is subject to GST where applicable and any retail price stated in the Product is denominated in Singapore Dollars.
 
Reservations with experience provider
  1. You are required to make an advance reservation with the Experience Provider for the redemption of the Elf Experience and One Time Special Offer. It is strongly recommended that advance reservation be made at least 7 days in advance. You are to quote the voucher number stated on the Elf Experience Voucher or One Time Special Offer Voucher when making the reservation of the Elf Experience or One Time Special Offer respectively. The experience provider will verify information quoted on reservation against the Elf Experience Voucher and One Time Special Offer Voucher.

  2. The provision of the service by the experience provider is subject to the specific conditions of the selected experience provider, including but not limited to terms of cancellation or modification of the reservation, age limit and physical conditions of the beneficiary. Some of the activities require a minimum level of health and fitness. You are advised to look at the experience provider’s terms and conditions to confirm that you meet the requirements.

  3. All changes to or cancellations of the reserved date shall be made with the experience provider and subject to their terms and conditions. If you or the recipient of the Elf Experience Voucher or One Time Special Offer Voucher is absent on the reserved date without notifying the experience provider, the particular Elf Experience Voucher or One Time Special Offer Voucher may be considered redeemed and will not be valid for any further redemption.

  4. You must make your reservation for experience directly with the experience provider. You may be asked to provide non-public personal information, such as a credit card number, when making reservations with experience provider, and we are not responsible for the experience provider’s use of such personal information. Elf Experience is not responsible for the privacy practices of experience providers (even if they utilize Elf and Co’s name or logo(s)). We encourage you to be aware of this when you read the privacy policies of each and every experience provider; as such policies may differ from ours.

  5. The experiences provided by experience providers may be subject to certain terms, conditions and limitations. It is your responsibility to review an experience provider’s terms, conditions and limitations to confirm that you meet their specific requirements for service and agree with any such experience provider’s terms, conditions and limitations.
 
Modifications and Cancellations
  1. You are subject to the experience provider’s service modification and cancellation policies, including the payment of cancellation fees, if any. Elf Experience will not be responsible for any modification or cancellation fees.

  2. The experience and the experience providers presented in the Product may be changed during the validity period of the Elf Experience Voucher or One Time Special Offer Voucher. Elf Experience is committed to providing a substitute where appropriate. Please contact us for more information.
Experience Providers are independent contractors
  1. Elf Experience operates as an independent entity from any of its experience providers. Elf Experience makes no warranty of any kind regarding any voucher holder may receive in connection with its redemption. Experience providers’ personnel are independent contractors and not acting as agents or representatives of Elf Experience. Elf Experience assumes no liability whatsoever for any service, advice, or other services provided by such persons.

  2. Elf Experience, its officers, directors, employees, agents, resellers, distributors and third parties cannot accept responsibility for any consequences arising from the use of the vouchers, nor for any material on third party websites or locations, and cannot guarantee that any mention in the Product will be a suitable source of information. They shall not be liable for any loss, injury, claim, inconvenience, liabilities, damages, costs or expenses sustained as a result of advice contained in this Product or use of its vouchers or the performance or non-performance of any experience provider.

  3. Elf Experience’s vouchers are issued subject to the terms and conditions of each third party business and their terms and conditions. Elf Experience does not have any control over third party service providers and their operations. Elf Experience takes all reasonable precautions to ensure that the service providers we promote are safe and reliable. However, Elf Experience makes no guarantees or warranties about the services which are provided to you by third parties. We will also take all reasonable precautions to ensure that third party service providers are licensed and compliant, where a third party service provider is not properly licensed or compliant with any applicable law, by-law or regulation, Elf Experience accepts no liability for any loss or damage suffered by you or any third party as a result of such non compliance. Nothing in this terms and conditions will limit our liability for death or personal injury caused by negligence or wilful act or omission of Elf Experience. Except as specifically set out in these terms, to the extent permissible by law, Elf Experience disclaims and excludes all other warranties.

Indemnity
With the purchase of our Products, you agree to indemnify, defend and hold Elf Experience, its subsidiaries, affiliates, officers, agents, service providers, co-branders, and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your violation of this agreement, any applicable laws, or the rights of any third party.
 
Privacy Policy
The privacy of all of our users is important. Please review our Privacy Policy. If you do not agree with our Privacy Policy you may not purchase, use or redeem any Product.
 
Disclosure of Personal Information and Service Provider Content
Without limitation of any of the rights granted to Elf Experience herein, you acknowledge and agree that Elf Experience may preserve and disclose your personal information if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce our rights; or (iii) protect the rights, property, or personal safety of Elf Experience any individual or the public.
 
Disclaimer of Warranties
  • The products are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Elf Experience makes no warranty as to the accuracy, completeness or reliability of the product. You are responsible for verifying any information before relying on it.

  • No advice or information, whether oral or written, obtained by you from Elf Experience shall create any warranty not expressly stated in this agreement. Neither Elf Experience nor any of its providers shall be liable for any errors in any information supplied with the product, or for any actions taken in reliance thereon.
Limitation of Liability
To the maximum extent permitted by law, Elf Experience disclaims all liability, whether based in contract, tort (including negligence), strict liability or otherwise, and further disclaims all losses, including without limitation indirect, incidental, consequential, special or exemplary damages arising out of or in any way connected with use of the products, even if Elf Experience has been advised of the possibility of such damages. Without limiting the foregoing, Elf Experience’s aggregate liability arising out of or in connection with this agreement shall not exceed the amount paid by you to Elf Experience.
